  1. Data controller processes your personal data - according to the nature of the contract and the manner of representation - to the extent of: name, mailing address, numbers assigned in the relevant state registers, contact data, including e-mail address, telephone or fax number, position occupied within the organization or function held, scope of power of attorney. 
  2. Personal data were obtained directly from you or from:  
  1. in case of individuals engaged in sole proprietorship – from open public records (CEIDG);  
  2. in case of natural persons representing or acting on behalf of contractors - from your principal, who is a contractor of the Data controller and from open public registers (KRS, CEIDG);  
  3. in case of persons responsible for the performance of a contract - from your employer, who is a contractor of the data controller.  
  1. Disclosure of data is necessary to conclude a contract. Failure to provide the above data will prevent the conclusion and execution of the contract. Personal data will be processed for the following purposes:

  2. Performance of legal obligations incumbent on the Data controller, including making accounting and taxation settlements (legal basis - art. 6 para. 1 lit. c. GDPR);  
  3. Communication, administration and organization within the Inter Cars Capital Group, as well as defence against claims and investigation of possible claims resulting from the execution of the contract - i.e. the Data controller's legitimate interest (legal basis - Article 6(1)(f) GDPR);  
  4. Communication for purposes related to marketing initiatives organized by the Data controller, in particular contests, promotions and other similar activities (legal basis Article 6(1)(f) GDPR) - in a situation where it is required, after prior collection by the Data controller of the necessary consents. 

Personal data will be processed for the period necessary to perform the contract.

Personal data will be processed also for the period required by law (resulting from, among others, the accounting and tax regulations), filing an effective objection to the processing of data on the basis of a legally justified interest, as well as the statute of limitations of possible contractual claims provided for by the appropriate legal regulations. The time of processing is determined by the longest term of data processing.

Verification of the identity of the person concluding the contract on behalf of the contractor, communication, administration and organization within the Inter Cars Capital Group, as well as defence against claims and investigation of possible claims resulting from the execution of the contract - i.e. the Data controller's legitimate interest (legal basis - Article 6(1)(f) GDPR);
  3. Communication for purposes related to marketing initiatives organized by the Data controller, in particular contests, promotions and other similar activities (legal basis Article 6(1)(f) GDPR) - in a situation where it is required, after prior collection by the Data controller of the necessary consents;
  4. Performance of legal obligations incumbent on the Data controller, including making accounting and taxation settlements (legal basis - art. 6 para. 1 lit. c. GDPR).

  1. The Data controller may transfer your personal data outside the European Economic Area (“EEA”) to third countries. The data will be transferred on the basis of an enabling European Commission decision/standard contractual clauses concluded between the Data controller and an entity located outside the EEA. Your personal data may be transferred to suppliers of IT systems and services, entities providing the Administrator with services necessary for the performance of the contract linking the Administrator with the entity you represent, including legal, consulting, auditing, security, anti-fraud services, as well as: banks, courier and shipping companies, the post, entities from the Inter Cars Capital Group, and furthermore to state authorities and other entities on the basis of universally applicable laws.
  3. Each person has the right to request access to their data, rectification, deletion, transfer, restriction of processing, to object to processing, and the right to lodge a complaint to the supervisory authority. The right to object to the processing of data shall be exercised in the case of data processing based on the legitimate interests of the Data controller.
